Stay Order dated 12-05-2023, Pertaining to University Of Kashmir Junior Assistant Recruitment Process 2023.

Through CM no. 2698/2023, the petitioners are seeking indulgence of this court with respect to an intervening development having taken place after filing of the present writ petition.

In the writ petition filed by them, the petitioners are seeking the indulgence of this court for issuance of a mandamus for the respondent University to carry forward the selection process for the posts of Junior Assistant undertaken in terms of notification no. 3 of 2019 dated 28.10.2019.

The petitioners, along with other persons who at the relevant point of time were eligible to participate in the said selection process, appeared in the written test and were waiting with expectation for the outcome of the written test. However, they were only left in suspense as the same was being kept on hold by the respondent University without any rhyme or reason, thereby constraining the petitioners to approach this court through the medium of the present writ petition.

Reply/objections to the writ petition have been filed on behalf of the respondents in which the respondents are meaning to say that it is upon a purported direction of the Chancellor of the respondent University that the respondent no. 1 has been constrained to freeze the selection process for the notification no. 3 of 2019 dated 28.10.2019.

Through the instant application, the petitioners are bringing to the notice of this court an intervening development in the form of issuance of an advertisement no. 5 of 2023 dated 27.4.2023, issued by the University of Kashmir, i.e. the respondent no. 1, for the purpose of selection exercise for 59 posts of Junior Assistants for both open and reserved categories. Issuance of this notification no. 5 of 2023 dated 27.4.2023 is an act on the part of the University of Kashmir of overreaching this court, given that the adjudication of this writ petition is still pending. By issuance of the aforesaid notification, that too without leave of the court, the respondents are intending to non-suit the writ petitioners.

Thus, the petitioners seek interim indulgence of this court to stay the operation of the above-mentioned advertisement notice no. 05 of 2023 dated 27.4.2023.

Prima facie, a case is made out to show indulgence.

It is, therefore, directed that till the next date of hearing, the University of Kashmir shall not carry out any selection exercise in furtherance of the advertisement notice no. 5 of 2023 dated 27.4.2023. This order, however, shall be subject to objections from the other side.

As the date fixed in the main case is 19.7.2023, the same is preponed to list this application along with the main on 31.5.2022.
