Class-IV Provisional Selection List

 Provisional Selection List-Cum-Allocation of Cadres for Class-IV posts under provisions of the Jammu &  Kashmir Appointment to Class-IV (Special Recruitment) Rules, 2020 pursuant to Advertisement Notification No. 01 of 2020 dated 26.06.2020-

The JKSSB vide SSB/Secy/Class-IV/2021/ 3951-59 dated 25.05.2021, notified tentative merit / score of candidates obtained in the aforesaid written examination and asked the candidatesto submit grievances, if any with regard to score awarded to them; andIn response to the aforesaid notification, the Jammu and Kashmir Services Selection Board received around 17,000 representations from aggrieved candidates wherein primarily

Some candidates claimed change in the score awarded to them, Some candidates sought grant of additional marks for the parameters which carry additional weightage in the laid down criteria, due to their failure to mention the same in the online application form; Some candidates sought change of reserved category for failure to indicate the same in the relevant entry of the online application form.

 

In terms of Rule 5(5) of the Jammu and Kashmir Appointment to Class IV (Special Recruitment) Rules, 2020 read with amendment notified vide S.O. 193 dated: 17.06.2020, preferences were to be sought from the candidates in regard to allocation of cadres/departments in favour of the selected candidates and accordingly, the candidates vide Notice No. SSB/COE/PAA/2021/2986-94 dated: 25.03.2021 were called upon to furnish their preferences online from 26.03.2021 to 01.04.2021, No. SSB/COE/PAA/2021/3187-95 dated: 29.03.2021 and SSB/COE/PAA/2021/3394-3401 dated 08.04.2021, which was extended upto 02.05.2021 vide Notice No. SSB/COE/PAA/2021/3586-94 dated 23.04.2021


Rule 6(1) of the Jammu and Kashmir Appointment to Class IV (Special Recruitment) Rules, 2020 provides for preparation of Shortlist, four times the number of advertised posts and accordingly a Shortlist based on the scores obtained by the candidates in the written test and additional weightage claimed by them for different prescribed parameters in the online application form, was notified vide NoSSB/Secy/Sel/Class-IV/2021/4621-28 dated: 23.06.2021 and  the aforementioned shortlisted candidates were called for counselling-cum-document verification vide Notice No. SSB/Secy/Sel/Class-IV/2021/4832-39 dated: 07.07.2021, for verification of requisite documents to determine eligibility in light of prescribed qualification and entitlement for additional points as claimed, and subsequently finalise/revise merit of the candidates, wherever required in light of the laid down criteria.


Those shortlisted candidates who failed to appear for document verification were given another opportunity vide No.SSB/Secy/Sel/Class-IV/2021/6001-12 dated: 08.09.2021to appear for document verification before the designated officers both at Jammu and Srinagar and  the JKSSB also deemed it fit to seek from the shortlisted candidates, an undertaking duly attested by the Judicial Magistrate Class 1st to the effect that they do not possess higher than the prescribed qualification and accordingly, vide Notice Page 4 of 12 No.SSB/Secy/Sel/Class-IV/2021/4832-39 dated: 07.07.2021 asked the shortlisted candidates to produce the same in the Board and some of the candidates also approached the Hon’ble Central Administrative Tribunal and filed O.A. 61/517/2020 titled by N.K. Tripathi & Ors vs UT of J&K &Orsfor seeking quashment of condition 6 (iii) of the Advertisement Notification No. 01 of 2020 dated 22.06.2020.


The Hon’ble Central Administrative Tribunal, Jammu was pleased to dismiss the aforesaid O.A. vide judgement dated 28.07.2021, the operative part whereof is reproduced as under:-“…. we do not find any reason to quash condition No. 6 of the Advertisement Notice No. 01 of 2020 dated 22.06.2020 issued by JKSSB. Accordingly, the O.A. is dismissed” and , the JKSSB received various representations that a considerable number of shortlisted candidates, despite being graduates and above, are furnishing wrong affidavits with the intention of getting selected for the aforesaid Class IV Posts; and the JKSSB accordingly considered it appropriate to analyse the data available for the posts having graduation or above as educational qualification and for which written examination were held in recent past, so as to gauge the extent of misrepresentation and furnishing of wrong affidavit by the candidates shortlisted for Class IV Posts


In view of the above, the JKSSBvide Notice No. SSB/Secy/Class-IV/2021/6013-21 Dated: 08.09.2021, provided an opportunity to all such higher qualified candidates who have applied for Class-IV Posts, to withdraw their candidature voluntarily against the aforesaid posts by or before 22.09.2021, failing which the JKSSB shall take necessary action as deemed appropriate under rules; andPage 5 of 12 in pursuance to the decision of the Board in its 188th Board Meeting a Revised Merit List of 5527 Eligible Candidates was prepared and notified vide No.SSB/Secy/Class-IV/2021/6882-91, dated 08.10.2021, and the GAD vide SO-184, dated 04.06.2020, read with SO-351, Dated 18.11.2020, has notified the procedure for allocation of Cadres/ Departments for Class-IV posts as under:-“Candidates will be required to indicate their order of preference for allotment against District /Divisional /UT Cadre vacancies at the time of application or as and when considered appropriate by the Board”


The JKSSB at para-9 (vi) of the Advertisement Notification No.01 of 2020 had laid down as under:-in case a candidate does not indicate his/ her preference (fully or partially) as and when asked by the Board, he/she shallbe deemed to have agreed to the Cadre and Department allocation as shall be done, by the Services Selection Board, and the decision of the Board in this regard shall be final and binding. Whereas, the Selection Committee also recommended to 

adopt a rational mechanism based on parameters of Domicile District, adjoining District, next adjoining District; Domicile Divisions etc. for allocation of Cadres, in case of such candidates who failed to furnish their preferences despite repeated extension of Dates; and

xxii. The Selection Committee on the basis of aforesaid norms and parameters and considering the rule 7 of SRO 294 of 2005 prepared a draft Provisional Selection List–cumAllocation of Cadres in favour of eligible candidates figuring in the Revised Merit List

xxiii. The draft Selection List-Cum-Allocation of Cadre was placed before the Board in its 190thmeeting held on 15thof Page 6 of 12 October 2021, and after threadbare discussion, the draft List as referred to above, was approved for notification and accordingly Provisional Selection List-Cum-Allocation of Cadres for Class-IV posts advertised vide Notification No. 01 of 2020, dated 26.06.2020, was notified Notification No. SSB/Secy/Class-IV/2021/7072-81 Dated: 15.10.2021

XXiv. The final Selection List alongwith allocation of departments in respect of 5175 candidates was forwarded to the General Administration Department vide letter No. SSB/Secy/Sel/class-IV-2021/7103-11dated 18.10.2021; and

xxv. Whereas, against the 8575 posts only 5175 candidates were selected for the Class-IV posts and also while finalizing the selection the horizontal reservation @ 4% to the Physically Disabled Persons were not considered and horizontal reservation @ 6% to the Ex-Serviceman which was partially considered, the Jammu and Kashmir Services Selection Board felt it necessary to seek clarification from the General Administration Department with regard to identification of disabilities of persons among the 4% horizontal reservation for PWD candidates and also to call additional candidates for counselling-cum-document verification for Class-IV posts and in this regard a letter was written to the General Administration Department vide letter No. SSB/Class-IV/Adm/58/2021/7418-21 dated 29.10.2021 and No. SSB/Sel/Secy/2021/3971-75 dated 27.05.2021
